Terms of Use

Last updated: 19 October 2026

These terms govern your use of missioncriticalengineers.com and mcforensics.com (the "Websites"), which are owned and operated by Mission Critical Engineers Ltd. ("MCE", "we", "us"), which also carries on business under the trade name Mission Critical Forensics ("MCF"). By using the Websites you agree to these terms. If you do not agree, please do not use them.

1. Information, not advice

The Websites describe our services and publish articles, guides and other material for general information. Nothing on the Websites is engineering, legal or other professional advice, and nothing on them is a sealed or certified engineering document. Engineering judgment depends on the facts of a specific facility, system and jurisdiction. Do not act, or refrain from acting, on anything on the Websites without obtaining advice from a qualified professional who knows your circumstances. We work to keep the Websites accurate and current, but we do not promise that they are free of error or up to date, and we may change them at any time without notice.

2. No professional relationship

Reading the Websites, downloading a document, subscribing to our newsletter or sending us an enquiry does not make you a client of MCE and does not create a consultant-client, advisory, fiduciary or other professional relationship. We become your engineer only when a written engagement agreement says so, and then that agreement, not these terms, governs the work.

3. Documents you download

Capability sheets, briefs, white papers, checklists and similar documents offered on the Websites are provided for your own, or your organization's, internal business use. You may store and print them for that purpose. You may not republish, sell, modify or remove the notices from them, or present them as your own work. They are general in nature and subject to section 1.

4. Your use of the Websites

You may use the Websites only for lawful purposes. You must not: attempt to gain unauthorized access to any part of the Websites, their servers or data; probe, scan or test their security; introduce malicious code; use automated means to copy the Websites or to submit forms; send us unlawful, defamatory or infringing material; or use the Websites in a way that disrupts them for others. We may suspend or end anyone's access for breach of these terms, and we may involve law enforcement where appropriate.

5. Our content and trademarks

The Websites and everything on them, including text, images, diagrams, animations, video, downloadable documents, design and code, are owned by MCE or used with permission, and are protected by Canadian and international copyright law. You may view, download and print pages for personal or internal business reference, provided you keep all notices intact. Any other use requires our written permission. "Mission Critical Engineers", "Mission Critical Forensics", "MCE", "MCF", "MCX" and our logos are trademarks of Mission Critical Engineers Ltd., whether or not registered. Other names and marks on the Websites belong to their owners. Nothing on the Websites grants you a licence to use any trademark.

6. Links to other websites

The Websites link to other sites we do not control, and other sites may link to ours. We are not responsible for the content, security or privacy practices of any other site, and a link is not an endorsement. You may link to our pages from your own site provided you do not frame them or suggest that MCE is associated with or endorses your site.

7. What you send us

Enquiries, applications and other messages you send us through the Websites are handled under our Privacy Policy. If you send us ideas, comments or suggestions about the Websites or our services, you grant MCE a perpetual, royalty-free licence to use them for any purpose, without obligation to you. Please do not send us confidential or proprietary technical information through the Websites' public forms; use the channel agreed in an engagement instead.

8. Privacy

Our Privacy Policy and Cookie Policy explain how we handle personal information collected through the Websites. They form part of these terms.

9. Disclaimer of warranties

The Websites and their content are provided "as is" and "as available". To the fullest extent permitted by law, MCE makes no representations, warranties or conditions of any kind, express or implied, including as to accuracy, completeness, currency, merchantability, fitness for a particular purpose, non-infringement, or that the Websites will be uninterrupted, secure or free of viruses or other harmful components.

10. Limitation of liability

To the fullest extent permitted by law, MCE and its directors, officers, employees and agents will not be liable for any loss or damage of any kind, whether direct, indirect, incidental, special, consequential or punitive, including lost profits, lost data or business interruption, arising from or connected with your use of, or inability to use, the Websites or anything on them, or any linked site, however caused and under any theory of liability, even if we were advised of the possibility. Your only remedy for dissatisfaction with the Websites is to stop using them. To the extent the law allows, any claim arising from your use of the Websites must be brought within six months after it arises. Nothing in these terms limits liability that cannot be limited by law.

11. Indemnity

You agree to indemnify MCE and its directors, officers, employees and agents against claims, losses and reasonable legal costs arising from your breach of these terms or your misuse of the Websites.

12. Accessibility

We want the Websites to be usable by everyone and we work toward the Web Content Accessibility Guidelines. If you have difficulty using any part of the Websites, or need information in another format, contact us (section 15) and we will help.

13. Governing law and disputes

These terms and your use of the Websites are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. If a dispute arises, we will each try in good faith to resolve it directly. Any claim that is not resolved must be brought in the courts of Ontario sitting in Toronto, and you agree to their exclusive jurisdiction. We administer the Websites from Toronto and make no representation that their content is appropriate or available elsewhere; if you use them from another place, you are responsible for complying with local law.

14. Changes, and general terms

We may change these terms by posting a new version, with a new date, on this page; the change applies from posting. If any part of these terms is found unenforceable, the rest remains in effect. Our not enforcing a term is not a waiver of it. These terms, with the Privacy Policy and Cookie Policy, are the whole agreement between you and MCE about your use of the Websites; they do not replace any engagement agreement. You may not assign your rights under these terms; we may assign ours to a successor. These terms are written in English; any translation is for convenience only.
